Cart system Licensing

This User/Licensing Agreement (hereinafter referred to as "Agreement") is a legally binding agreement between you (hereinafter referred to as "User") and Art of the Cart (hereinafter referred to as "Licensor") for the use of the Cart System products (hereinafter referred to as "Item").By purchasing, downloading, or using the Item, User acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this Agreement.

LICENSE GRANT

Licensor hereby grants User a non-exclusive, non-transferable, worldwide license to use the Item for personal, commercial, or client work, subject to the terms and conditions of this Agreement.


LICENSE RESTRICTIONS

User may not:

Share the item link into the web or distribute (e.g. embed) with Figma public access.

Share the item to Figma Community.

Place any of Item design files into the End Product as it is.

Redistribute the Item as stock, in a tool or template, or with source files. User can't do this with an Item either on its own or bundled with other items, and even if they modify the Item.

Re-distribute or make available the Item as-is or with superficial modifications.

Permit an end-user of the End Product to extract the Item and use it separately from the End Product.

Publish the Item in their team library or give edit permissions to other people if they bought the individual license.

Create website ‘theme’ files and distribute them for public use or purchase.

PERMITTED USES

User may:
Create an End Product for a client.

Create an End Product for personal or commercial use.

Sell or distribute and make any number of copies of the End Product.

Combine the Item with other works and make a derivative work from it. The resulting works are subject to the terms of this license.

Use the Item multiple times, in multiple projects, as this is a 'multi-use' license.

Publish the item in their team library or share the files within their organization for participants only if they've bought the Startup or Enterprise license. Startup and Enterprise license allows User to give edit permissions to other team members of their company (depends on the license they bought): up to 5 editors or unlimited editors.

Sell copies of the Cart System to other businesses as an affiliate. Contact us for terms.

UPGRADING YOUR LICENSE

If User wishes to extend their license to a higher tier, they must contact Licensor with the details:

The email address they’ve purchased the license

The license name they want to upgrade to

REFUND POLICY

Licensor recommends checking out the Figma previews, free file previews, and other marketing materials to learn about the Cart System prior to purchase. User agrees to make use of it and decide if it's for them or not.

However, if for any reason, the Cart System is not what User expected, Licensor will process the refund if User contacts them within 14 days of purchase. User must drop Licensor a line at info@artofthecart.com, and Licensor will issue a refund within 30 days.

Please note there are no exceptions to the refund policy terms.

Please note that upon refund:

User will have to delete all files (from their drive and from their Figma account).

User will no longer be able to use the Cart System products in any projects if Licensor issues a refund (including personal/non-commercial projects).

Licensor will be able to identify if the system is in use after the refund.

INTELLECTUAL PROPERTY

The Item is the intellectual property of Licensor and is protected by copyright laws and treaties. User acknowledges that all rights, title, and interest in and to the Item, including any intellectual property rights, are and shall remain with Licensor.

DISCLAIMER OF WARRANTY

The Item is provided "as is"
